Terms and conditions
You agree to be bound by the terms and conditions as written out below. All purchases made online, over the phone or in store are governed by these Terms and Conditions.
Each Order is a separate legally binding contract. You should read these terms and conditions carefully and make sure you understand them. Please note that we may amend these Terms from time to time.
- DEFINITIONS:
1.1 In these terms and conditions and your sale agreement, the following words shall have the following meanings:
“You” or “Your” means you as our customer
“We”, “Us” or “Our” means Sam Beds, 465 Oxford Road, Reading, Berkshire, RG30 1HF.
“Order” means your order for the Goods;
“Goods” means all Goods listed in the Order;
“Made to Measure” mean any Goods that are made to specific.
“Delivery” means the delivery of the Goods to the delivery address.
“Website” means samsbeds.co.uk.
“Working day” means weekdays excluding weekends and public holidays.
- ORDERS:
2.1 These terms and conditions apply to Orders placed online or over the phone.
2.2 It is your responsibility to check all the information you provide is accurate when placing an order.
2.3 We will send a confirmation of your Order by e-mail and the Order will be accepted by Sams Beds.
2.4 It is your responsibility to check the sizes of all goods to ensure that they will fit into your property; we offer an additional service to assemble or dispose goods, if you would like this service please add it in the Order, these will be shown separately. If they are not included in the Order then these services have not been purchased and will not be provided. These can be added by calling our customer Service team on 0118 212 0440.
- GOODS:
3.1 We have made every effort to ensure product description, photos, size, material and colour are accurate but Goods may vary slightly.
3.2 When placing a mattress on a bedstead please note that there may be a gap around the edges; this is to allow mattress rotation.
3.3 We offer 12 Months manufacturer warranty on mattresses from the date of Delivery.
3.4 The warranty will be voided if an improper base is used that causes the mattress to fail.
3.5 This warranty does not include any deterioration of the foam, with an indentation of less than 1.5 inches not associated with a sag in the foundation, box spring or platform or mattress.
3.6 If the mattress is found to have been tampered with or misused beyond reasonable wear or it has been physically damaged due to accident and/or neglect; including burns, cuts, water damage, mold, stains, or is otherwise abnormally soiled or unsanitary, the warranty will void.
3.7 If You inform us that the goods have breached the guarantee, we will arrange an inspection to verify this. If this inspection finds that the goods have not breached the guarantee, We will decline any further action, but provide full details of the reasons for the decision.
3.8 Your Mattress will be replaced should it be found defective because of faulty workmanship or structural defects. Please retain your original invoice.
3.9 Direct contact with heat and sunlight should be avoided as these may cause fabrics to fade.
3.10 Always follow the manufacturer’s cleaning instructions and only use products recommended by them.
- PRICE
4.1 The price of the Goods is as indicated on the order pages when You submit Your order to purchase the Goods on the Website.
- PAYMENT
5.1 We require payment in full before production of Goods will start.
5.2 You can pay by PayPal or finance is available.
5.3 An additional option of finance may be taken by You, subject to status. The contract shall not have been concluded until any documents that require signatures are returned and completed. We cannot be responsible for delays to Your delivery date caused by the delayed decision from the finance provider.
- 6. DELIVERY
6.1 Delivery options and costs will be calculated as part of the order process, and Your available options will be made clear before You place an order.
6.2 We will aim to deliver Your Products within the time-frame referred to on the Order Confirmation. All delivery times quoted at the time of order are estimated and cannot be guaranteed.
6.3 Delivery will be made to the delivery address specified on the Order and any changes to a delivery address must be supported by documentary evidence. You must notify us at least 72 hours prior to Delivery of any delivery amendments. Any amendment however small may lead to an increase in lead-time or change of delivery date.
6.4 We may be unable to deliver to some locations. Please contact our customer service team on 0118 212 0440 for more information.
6.5 If, as a result of circumstances beyond our control, we are or reasonably believe that we will be unable to complete Delivery of the Goods, we will be entitled to cancel the Order and will provide You with a full refund of all amounts paid.
6.6 The Goods may require installation. If You have purchased an installation service, this will be provided by our expert delivery team. If You have not purchased this service, it is Your responsibility to install the Goods. Please note that the availability of installation services is dependent on the post code being delivered to.
6.7. You should inspect the Goods carefully upon Delivery. If installed by Us at the delivery address, Goods will be deemed accepted once installed unless You inform us otherwise at the time. Where Goods are not removed from their packaging or You have otherwise not had a reasonable opportunity to inspect the Goods on Delivery, the Goods will be deemed accepted 3 days after Delivery.
6.8 We will notify You in verbally once the Goods are ready for Delivery.
6.9 In the unlikely event that there is an issue with Your Goods on arrival, please notify Us upon becoming aware of it and Our customer service team will help to resolve the matter for You as quickly as possible.
- CANCELLATION:
7.1 If you decide you want to cancel prior to delivery, please contact our customer service team straight away on 0118 212 0440 or email customercare@samsbeds.co.uk. You will need to let us know in writing that you have decided to cancel and the refund will be processed within 7 working days from the cancellation notice.
7.2 If you notify us of cancelling your order after the goods have been booked in for delivery, there will be a 50% fee of the item value if it’s a ‘Bespoke Made to Order’ item.
- REFUNDS:
8.1 You can return goods for a refund within 14 days of delivery in the original condition and packaging.
8.2 You are responsible for the costs of returning items. If you choose for us to arrange for them to be collected, there will be a return shipping charge. Please call the customer service team for further information.
8.3 We will process the refund within 7 working days from the date we receive the goods.
8.4 If a refund is given under the terms of the 12 months guarantee, We reserve the right to deduct from the refund a reasonable amount in line with the amount of use You have had from the Goods, prior to reporting the fault.
8.5 Return of items subject to Credit; The purchase of any Goods on credit terms is made with a finance agreement between You and the finance company. If You want to return Goods that have been purchased under a finance agreement, We will return to the finance company and all sums advanced by the finance company in relation to their agreement with You once We have received the returned Goods including any return fees.
- DISPOSAL
9.1 The collection and disposal of your old beds/mattresses is an additional and chargeable service. Please get in touch with the customer service team.
- UNLIKELY EVENT:
10.1 We will not be liable or responsible for any failure to perform Our obligations under the Order that is caused by events outside Our reasonable control. These include the following:
10.2 delays caused by one of Our suppliers.
10.3 strikes, lock-outs or other industrial action;
10.4 natural disasters such as fire, explosion, storm, flood, snow.
10.5 unavailability of shipping, aircraft, motor transport or other means of public or private transport; or
10.6 unavailability of public or private telecommunications networks.
- OUR LIABILITY TO YOU:
11.1 We do not accept any responsibility for damage to Your property during Delivery other than damage due to Our negligence when Our liability is limited to Your direct costs to repair that damage.
11.2 Our total liability in connection with or arising from the Order, whether in negligence or otherwise, shall be limited to the value of the Goods.
11.3 We shall not be liable for any indirect or consequential losses, costs or expenses in connection with or arising out of the Order.
11.4 Nothing in these terms and conditions excludes or limits liability for death or personal injury caused by negligence, fraud or any other liability which may not otherwise be limited or excluded under applicable law.
- PRIVACY AND CONFIDENTIALITY:
12.1 We are committed to protect Your privacy. We will only use the information that We collect about You in accordance with applicable data protection legislation and Our Privacy Policy available on Our website. It is important that You read this privacy policy. Please note that when You agree to these Terms and Conditions, We shall consider that You have also read and understood Our Privacy Policy.
